Executive Order Number 20-180(Entered 07/29/20–Extended to 09/01/20)

  • Suspends and tolls any statute providing for final action at the conclusion of a mortgage foreclosure/eviction proceeding under Florida law solely when the proceeding arises from nonpayment of mortgage/rent by asingle-family. mortgagor/residential tenant adversely affected by the COVID-19 emergency.
  • Adversely affected by the COVID-19 emergency means loss of employment, diminished wages or business income, or other monetary loss realized during the Florida State of Emergency directly impacting the ability of a single-family mortgagor/residential tenant to make mortgage/rent payments.

What does this Mean?

  • Foreclosure and Eviction Actions can be filed in Florida. EO only halts finalactions in certain foreclosures and evictions.
  • EO does not cover tenants when leases expired or when non-payment occurs due to reasons other than COVID-19.•EO applies only to residential foreclosures/evictions–not commercial.
