American conglomerate 3M, known for developing protection and safety equipment for consumers, health care and other industries, faces a class action lawsuit for allegedly manufacturing faulty earplugs it sold to the military for use by service members in the Iraq and Afghanistan wars. Specifically, the Combat Arms Earplug (CAEv2) meant to prevent American troops who served between 2003 and 2015 from experiencing hearing loss.

The Combat Arms Earplug featured a dual-protection design which depending on the end that was inserted, would allow soldiers to either block out all noise or blocking out loud noises while still being able to hear more subtle noises.

The lawsuit alleges that 3M knew from testing that the earplugs were too short to fit properly into an ear canal and could loosen in a way not perceptible to the wearer. In July, 2018, the Justice Department announced that 3M agreed to pay $9.1 million to resolve allegations that it knowingly sold the earplugs to the military without disclosing defects that hampered its effectiveness. That lawsuit was filed through the whistleblower provision of the False Claims Act. The settlement money went to the government, not individual service members or veterans. Individual lawsuits have now been filed against 3M due to the faulty earplugs which caused hearing loss and ringing in the service member’s and veteran’s ears, and is expected to go to trial in 2021.
